            The Dallas chapter of the Military Order of Purple Hearts Club has about 300 members, limited to those who have suffered wounds in combat.  The MOPH has their annual fundraising dinner to collect funds to help other Veterans who are in need on December 15, 2012.  Over 200,000 veterans have benefited from MOPH to date, plus MOPH also helps disadvantaged children and often helps Vets by presenting Veteran claims to courts.  Call Vice Commander Bill McMaster at 972-273-0286 or Adjutant Paul Reed at 214-265-1433 to make contributions.

In this Will contest from Beaumont, we get one of the rare cases where undue influence was proven in the trial court, and managed to hold up at the Court of Appeals. Pearl Graef probated the 1989 will of her sister, Minnie Ola Kremer. Nearly two years later, Charles Lester Smith, a friend of Minnie’s, filed a motion to set aside the 1989 Will and instead probate a Will allegedly written by Minnie in 2004. (more…)

What are the statutory requirements for a Will in Texas.

The first place to start in a Will contest, is, not surprisingly, the Will itself. In Texas, a Will must be in writing in all but the most limited circumstances. If you knew the Decedent to have a Will, examine the one offered for probate. Is it the same document you knew to be the decedent’s Will? If not, is it consistent with what the Decedent relayed to you concerning the disposition of his Estate? Also, determine if the Will is from a familiar source. Most probate attorneys have some form of identification on their Wills. If you find it, ensure that it is a lawyer you knew the Decedent had used in the past or was at least familiar with.
